I Am Getting a Divorce. Do I Have to Go to Court?

     In Minnesota, will I have to go to court for my divorce? That is a frequent question I get from clients at initial consults. The answer is: it depends.  

    Divorce clients that can avoid going to court:

  1. Couples that have children, agree on everything,have submitted the correct written agreement and both have lawyers or
  2. Couples that do not have children, agree on everything (regardless of whether lawyers are involved) and have submitted the correct written agreement.

    Divorce clients that have to go to court:

  1. Couples that have children, agree on everything, and have submitted the correct written agreement but either one or both of them don’t have lawyers or
  2. Couples that don’t agree on everything.
